1. About these terms
This website is operated and the services are provided by Asfar Albayt Office for Travel and Tourism (ARM Trips), Kingdom of Saudi Arabia, referred to as “ARM”, “we” or “us”.
“Customer” means the business that requests or uses the services. “User” means any person the Customer allows to access its workspace. “Workspace” means the Customer’s private environment in the system.
By using the website, sending a subscription request or using the services, you agree to these terms, the Privacy Policy and the Cancellation and Refund Policy. If you accept on behalf of a business, you confirm you are authorized to do so.
If the Arabic and English versions differ, the Arabic version prevails.
2. Services and packages
ARM provides technology solutions for businesses, including the cloud-based ARM ERP, B2B and B2C booking portals, messaging services, and website and app development, as described on the website or in an agreed offer.
Each package’s features and limits (such as users and available modules) are those published at the time of subscription or stated in a written offer. We continually improve the services; if we materially reduce a paid package’s features during its term, we will give at least 30 days’ notice.
The services are intended for business use, not for personal consumer use.
3. Subscription requests and activation
Sending a subscription request through the website is not a binding contract and does not reserve a workspace address. The subscription starts when ARM confirms receipt of payment and activates the workspace.
The Customer must provide accurate, up-to-date information. ARM may decline a request or ask for documents to verify the business, and will refund any amount received for a declined request.
If a free trial is offered, its length and conditions are shown before signup, and no subscription fee is charged before it ends without the Customer’s consent.
4. Prices, payment and invoices
Prices are in Saudi riyals and are shown including 15% VAT, with the pre-VAT amount and the VAT stated, under the VAT Law and its Implementing Regulations. If the statutory VAT rate changes, the new rate applies.
Payment methods: bank transfer to the account shown on the website and when you submit a request, and electronic payment (mada, Visa, Mastercard and Apple Pay) through the licensed Paymob gateway. ARM never sees or stores card details; they are processed by the payment gateway.
ARM issues a tax invoice in line with statutory requirements after payment is received.
We may change prices for future periods with at least 30 days’ notice. Changes never apply to a period already paid.
If a renewal invoice is not paid on time, ARM may suspend the service after notice until payment is made.
5. Renewal and cancellation
A subscription renews for the same period (monthly or yearly) once the renewal invoice is paid. Bank-transfer subscriptions are never charged automatically.
The Customer may cancel at any time. Cancellation takes effect at the end of the paid period unless the Cancellation and Refund Policy provides otherwise.
Refunds are governed by the Cancellation and Refund Policy published on the website.
6. Customer data and data protection
Data the Customer and its Users enter into the workspace (such as traveler, booking and financial records) remains the Customer’s property.
ARM processes this data as a processor on the Customer’s behalf, on its instructions and only to provide the services, in line with the Personal Data Protection Law, its regulations and the Data Processing Agreement. The Customer is the controller, responsible for the lawful collection of the data and for obtaining any required consents.
We apply appropriate technical and organizational security measures, limit access to team members who need it to provide the service or support, and notify the Customer and the competent authorities of a personal data breach within the statutory timeframes.
We may use service providers (such as hosting and email) to deliver the services, some located outside the Kingdom, subject to the cross-border transfer safeguards described in the Privacy Policy.
The Customer may request a copy of its data in a common format during the subscription and for 30 days after it ends. We then delete it within 90 days of the end of the subscription, except where retention is required by law.
7. Acceptable use
The Customer and its Users must not:
- Use the services for any activity that violates the laws of the Kingdom, including the Anti-Cyber Crime Law and the Electronic Transactions Law.
- Attempt unauthorized access to systems or other customers’ data, or run security or load tests without ARM’s written permission.
- Resell, rent or make the services available to third parties without a written agreement.
- Send unsolicited marketing through messaging tools, or upload harmful or unlawful content.
- Reverse-engineer or copy the software, except as permitted by law.
The Acceptable Use Policy sets out these rules in detail. The Customer is responsible for keeping login details secure, for all activity under its Users’ accounts, and for telling us immediately about any unauthorized use.
8. Intellectual property
ARM’s software, designs, trademarks and content belong to ARM or its licensors and are protected by applicable laws, including the Copyright Law.
ARM grants the Customer a limited, non-exclusive, non-transferable license to use the services during the subscription for its internal business purposes only.
ARM may use feedback and suggestions from the Customer to improve the services without obligation.
9. Availability and support
We take reasonable care to keep the services available. They may be interrupted for maintenance, updates or reasons beyond our control; we aim to announce planned maintenance in advance where possible.
Support is provided through the channels included in the package, including support@armtrips.com and WhatsApp. ARM does not commit to a specific availability level unless agreed in a written service level agreement.
The services may integrate with third parties (such as payment gateways, WhatsApp and booking suppliers). Their use is subject to those parties’ terms, and ARM is not responsible for their interruptions or changes.
10. Confidentiality
Each party will keep the other’s non-public information confidential and use it only to perform these terms, unless disclosure is required by law or a competent authority.
11. Limitation of liability
The services are provided “as is” to the extent permitted by law, and ARM gives no warranties other than those expressly stated.
ARM is not liable for indirect or consequential damages, loss of profits or opportunities, or loss of data resulting from the Customer’s use or its failure to keep its own backups.
ARM’s total liability for any claim is limited to the amounts the Customer paid ARM for the relevant service in the 12 months before the claim.
Nothing in this section limits liability for fraud, gross negligence or anything that cannot be limited by law.
12. Suspension and termination
ARM may suspend or terminate the service if the Customer materially breaches these terms and does not remedy it within 14 days of notice, fails to pay, if a competent authority requires it, or to protect system security.
When a subscription ends or is terminated, the right to use the services ends, and the data export and deletion terms in “Customer data” apply.
13. Changes to these terms
We may update these terms and will publish the updated version on this page with its effective date. For material changes, we notify existing customers at least 30 days in advance by email or in the system.
14. Governing law and disputes
These terms are governed by and interpreted under the laws of the Kingdom of Saudi Arabia.
The parties will try to settle any dispute amicably within 30 days of notice. If that fails, the dispute is referred to the competent judicial authorities in the Kingdom of Saudi Arabia.
